THE
PERSONAL BAGGAGE AND GIFT SCHEME (IMPORT OF CARS,
BUSES,
TRUCKS AND LIGHT COMMERCIAL VEHICLES) ORDER, 1993
S.R.O.
599(I)/93.- In exercise of the powers
conferred by sub-section (1) of section 3 of the Imports and Exports (Control)
Act, 1950 (XXXIX of 1950), and in supersession of S.R.O.597(I)/84, dated the
5th July, 1984, vehicles, the Federal Government is pleased to make the following
order, namely:-
1. Short title and commencement.- (1)
This Order may be called the Personal Baggage and Gift Schemes (Import of Cars, Buses, Trucks and
Light Commercial Vehicles) Order, 1993.
(2) It shall come into force at once.
2. Definition.- In this Order, unless there is anything repugnant in the subject
or context.-
(a) "Authority" means an officer
of the Federal Government authorised by it to perform the functions of the
Authority under this Order within such area as the Federal Government may, by
notification in the official Gazette, specify;
(b) "bus" means
standardised passenger vehicle notified as such by the Ministry of Commerce
from time to time;
(c) "car" includes a station
wagon, van, delivery van, pick up and 4x4 vehicles but does not include all
passenger vehicles of seating capacity of more than twelve persons including driver and cargo carriers
of an engine capacity exceeding 1600 cc;
(d) "earning certificate" means
a certificate issued by an authorised officer of Pakistan Embassy, Consulate or
Mission abroad (including Honorary Consulate) in the form at Annex-I;
(e) "family" means parents,
husband, wife and children including step-children wheather married or not but
excluding minor children;
(f) "gift undertaking" means a
certificate issued by an authorised officer of Pakistan Embassy, Consulate or
Mission abroad (including Honorary Consulate) in the form at Annex-II;
(g) "last six months"
for the purpose of importing a car means continuous stay abroad of six months
without any visit to Pakistan;
(h) "last two years" for the
purpose of eligibility to import or gift another car, means a period of two
years from the date on which previous import permit was issued for the car
gifted or imported;
(i) "light commercial
vehicle" means vehicle notified as such by the Ministry of Commerce from
time to time;
(j) "Pakistani national" means
citizen of Pakistan residing abroad and includes a person having dual
nationality and a foreign national of Indo-Pakistan origin;
(k) "truck" means cargo vehicle
notified as such by the Ministry of Commerce from time to time; and
(l) "two years stay abroad"
means stay of not less than two years in a foreign country during which no
single visit to Pakistan has exceeded sixty days at a time.
3. Cars.- (1) The following persons are eligible to import
or, as the case may be, gift a car under this Order, namely:-
(i) A Pakistani National having a
continuous stay of last six months abroad is entitled to import a new or a used
car which are not more than two years
of age under personal baggage, provided that the used car was registered in his
name in the country of his residence abroad at least sixty days prior to his
departure for Pakistan;
Provided that Overseas Pakistani
having stay abroad of at least six continuous months, shall be allowed to
import motor cars with engine capacity of 1800 cc and above and 4 x 4 wheel
drive luxury vehicles in new condition. The duty and taxes will, however, be
paid out of foreign exchange arranged by Overseas Pakistani themselves or local
receipient supported by bank encashment certificate showing conversion of
foreign remittance to local currency; and
Provided that the import of more than
two years' old car or vehicle, having
remained in use of the importer in the foriegn country of his residence for the
aforesaid period, shall be allowed under the Trasnfer of Residence Scheme
subject to the following conditions, namely:-
(a) The
Pakistani National is transferring his residence from abroad after a continuous
stay of two years;
(b) he
makes a declaration on his arrival in Pakistan that he intends to import the
car or vehicle under the Transfer of
Residence Scheme;
(c) this
concession shall be availed in case of cars or vehicles which are transferred
from a country wherein the
said Pakistan National normally resides; and
(d) this
concession shall be availed in case of cars or vehicles which are shipped
within fifteen days of the arrival of the Pakistani National in Pakistan in
case of cargo coming by air and within sixty days of his arrival in case of cargo coming
over land route or by sea.
(e) The importer shall have -
(i) valid driving
licence; and
(ii) registration
document of the vehicle duly attested and stamped by the concerned Pakistan
Embassy or Pakistan Consulate.
(ii) a Pakistani
national having two years ' stay abroad is entitled to gift a new car to a
member of his family in Pakistan;
(iii) a Pakistani
national having no definite country of residence abroad, for example a seaman,
can import only a new car; and
(iv) both husband and
wife may separately import or gift a car provided that they are otherwise
eligible to do so under this Order.
(v) Notwithstanding
anything contained in the preceding sub-paragraphs Overseases Pakistanis having
stay aborad of at least six months, shall be allowed to gift any number of new
cars of engine capacity of 1800 cc and above and 4 x 4 wheel drive luxury
vehicles to any one in Pakistan.The duty and taxes will, however, be paid out
of foreign exchange arranged by Overseas Pakistanis themselves or local
receipient supported by bank encashment certificate showing conversion of
foreign remittance to local currency.
(2) The following are not eligible to import or,
as the case may be, gift a car under this Order, namely :-
(i) An official who is in transit (in
Pakistan) or on home leave from his post in another country;
(ii) a Pakistani student abroad receiving
foreign exchange remittance from Pakistan provided that a student who has not
received any remittance from Pakistan during twelve months prior to his return
to Pakistan shall be eligible to import a car if he fulfils the other
conditions, and a Pakistani student abroad who has not received any foreign
exchange remittance from Pakistan during two years prior to his return to
Pakistan shall be eligible to gift a car to a member of his family in Pakistan
provided that other conditions are fulfilled;
(iii) a minor, that is to say, a person who is under eighteen years of age;
(iv) non-earning members of the families of
Pakistanis living abroad;
(v) a person who has imported under Personal
Baggage Scheme or sent as gift a car during the last two years; and
(vi) a person in Pakistan who has received a
car as gift during the last two years from a member of his family abroad. (A
person shall thus be eligible to receive only one car as gift in two years).
(3) A person intending to import a car
under this Order (Personal Baggage) shall submit to the Authority an
application in the form at Annex-III alongwith the following documents, namely
:-
(a) Purchase receipt.- This document shall show the value of the car as well as the fact
that the order for purchase of the car was placed and full payment, including
freight, was made before the arrival of the importer in Pakistan;
(b) Bill of lading.- This document shall be produced if the car is imported by sea and
shall show freight pre-paid and shipment
of the car within four months from the date of arrival of the importer
in Pakistan. The importer shall be
shown as consignee.
(c) Customs Examination Report.- This document shall be produced in case of
cars brought by land route.
(d) Passport (s) :
(i) The
passport or passports covering at least last two years shall be produced so as
to verify the importer's requisite stay abroad and non-import or gift of car
during that period.
(ii) In
case of an importer, who holds dual nationality, import of car shall be allowed
only on Pakistani Passport.
However, to verify stay and
non-import of car during the last two years, foreign passports will also be
required to be submitted.
(iii) Other
foreign nationals of Indo-Pakistan origin will be allowed import on foreign
passports provided that such persons are eligible to hold Pakistani nationality
and fulfil the other conditions prescribed under this Order.
(4) A Pakistani national may, at his option
in liue of a car, import one motorcycle or scooter in completely built-up
condition.
(5) (i) A
Pakistani national abroad may gift a car to a member of his family in Pakistan
subject to the following conditions, namely:-
(a) He
has been in a foreign country for two years or more and has not visited
Pakistan for a period exceeding sixty days at a time.
(b) During
the last two years, he has neither imported a car under Personal Baggage nor
gifted a car to any other member of his family.
(c) The
car gifted had been purchased out of his own earnings abroad.\
(d) A gift undertaking duly attested
by authorised officer has been obtained from the Pakistan Embassy or
Consulate including Honorary Consulate
in the country of giftor's residence.
(e) The
giftee has not previously received a gift of a car from any other member of his
family during the last two years.
(ii) Gift
of asecond-hand or reconditioned car shall not be allowed.
(iii) A Pakistani national desirous of gifting a
car to a member of his family shall submit the gift undertaking, in triplicate,
alongwith his passport to the Pakistan Embassy or Mission or Consulate in the
country of his residence for its attestation by an authorised officer. The attesting officer shall return one copy
duly attested to the donor, send the other copy for confirmation to the
concerned authority and retain the third copy for his record. The giftor shall thereafter send the
attested copy of the gift undertaking to the giftee in Pakistan;
Provided
that the attesting officer shall ensure the gifter's financial capability to
gift a car.
(iv) A Pakistani national receiving the gift of
a car shall make an application in the form at Annex-III to the Authority
alongwith the following documents, namely :-
(a) Gift undertaking;
(b) National Identity Card of the giftee;
(c) Receipt of payment in the name of the
person gifting the car;
(d) Invoice; and
(e) Bill of Lading showing giftee as the
consignee alongwith his address.
(v) The Authority shall not release the car
unless the confirmation copy of the gift undertaking has been received:
Provided that if
the car has reached Pakistan and the confirmation copy of gift undertaking has
not been received by the licensing authority, permission to import the car may
be issued if the applicant produces bank guarantee in the form at Annex-IV and
of the value equal to approximately one-forth of the C&F value of the car.
(vi) The gift undertaking shall be valid for
six months from the date of its issue for the purpose of applying the import of
car.
(vii) Where any document referred to in
sub-clause (iv) is missing or is not readily available or has not been
received, the application for permission to import car shall be submitted to
the Authority with the bank guarantee in the fomr at Annex(IV) of the amount equal to the landed cost of
the car or such amount as deemed appropriate by the Authority.
(viii) The bank guarantee would specify the lacking
document(s) which shall be required to be produced within a reasonable time not
exceeding six months from the date of the release of car unless extended by the
Authority.
(ix) Application for import of car under gift
scheme will only be submitted and entertained by the Authority of the region of
the gift as stated in the gift undertaking.
4. Buses and trucks.- (1)
A Pakistani national residing abroad may import or gift to any adult
Pakistani national residing in Pakistan, irrespective of his relationship with
the Pakistani national making the gift, one or more buses or trucks, out of his
individual or personal earnings abroad, subject to the following conditions,
namely :-
(i) New buses or trucks may be
imported or gifted in chassis form;
(ii) Used or second-hand buses or trucks must
be in completely built-up condition and must not be more than two years of age;
(iii) The chassis in built-up condition may be
imported directly by the Paksitani national concerned;
(iv) Imports in completely knocked down
condition must be routed through recognised assemblers of the specific buses
and trucks in Pakistan.
Explanation.- In this sub-clause, the term "new"
means a bus or truck, whether in completely built-up or chassis form, of the
latest or current model purchased directly from the manufacturer or their agent
and not physically used before import.
(2) Application for permission to import buses
or trucks imported or gifted may be made to the Authority by the donee in the
form Annex-III along with the following documents, namely:-
(i) Earning
Certificate.- Certifying enough savings
so as to justify purchase of the vehicles (in case of gift or import of more
than one second hand or used trucks or buses);
(i) Earning Certificate.- Certifying enough savings so as to justify
purchase of the vehicles (in case of gift or import of more than one second
hand or used trucks or buses);
(ii) Receipt
of payment in the name of the importer/giftor showing payment before the
importer's arrival in Pakistan;
(iii) Invoice;
(iv) Bill of lading showing freight pre-paid
and, in the case of import as gift, giftee must be shown as consignee and in
case of imports under personal
baggage, importer should be shown as consignee;
(v) Registration book (in the case of used
second hand vehicle only) so as to determine the age;
(vi) Duly attested Power of Attorney executed
in favour of the person appointed to receive the import permit (in case
the importer is himself not in
Pakistan).
5. Light commercial vehicle.- (1)
A Pakistani national residing abroad may import or gift to an adult
Pakistani national residing in Pakistan, irrespective of his relationship with
the Pakistani national making the gift, one or more light commercial vehciles
out of his individual or personal earnings abroad, subject to the following
conditions, namely :-
(i) New light commercial vehicles may be
imported or gifted only in chassis form.
(ii) Used or second hand light commercial
vehicles must be in completely built up condition and must not be more than two
years of age.
(iii) The chassis in built-up condition may be
imported directly by the Pakistani national concerned.
(iv) Imports in completely knocked down
condition must be routed through recognised assemblers of the specific light
commercial vehicles in Pakistan.
(v) A Pakistani national may, at his option,
import or gift, in lieu of car, one light commercial vehicle in completely built up condition and, in such cases, rule
4 shall mutatis mutandis apply.
Explanation.- In this sub-clause, the term "new" means a light
commercial vehicle, whether in completely built up or chassis form, of the
latest or current model purchased directly from the manufacturers or their
agents and not physically used before import.
(2) Applications for import of light
commercial vehicles imported or gifted may be made to the Authority of the
address of the donee in the form at Annex-III, annexing the following
documents, namely:-
(i) Earning Certificate.- Certifying enough savings so as to justify
purchase of the vehicles (in case of gift or import of more than one second had
or used LCVs).
(ii) Receipt of payment in the name of the
importer/gifter showing payment before the importers arrival in Pakistan.
(iii) Invoice.
(iv) Bill of lading showing freight pre-paid in
case of import as gift, donee shall be shown as consignee and in case of
imports under personal baggage, importer should be shown as consignee.
(v) Registration book (in the case of used or
second hand vehicle only) so as to determine the age.
(vi) Duly attested Power of Attorney executed
in favour of the person appointed to receive the imported Light Commercial
Vehicles (in case the importer is himself not in Pakistan).
6. Import of cars by non-privileged
foreign nationals and restrictions on sale of such cars.- (1)
A non-privileged foreign national who comes to Pakistan on a specific
contract of service with any local or foreign firm or with a Government or
semi-Government authority in Pakistan can bring a car as personal baggage.
(2) The importer of the car shall submit to
the licensing authority an application for import permit in the form at
Annex-III, alongwith the following
documents, namely:-
(i) Passport.
(ii) A certificate from local or foreign firm
or contracting authority in Pakistan showing that the period of stay in Pakistan
of foreign national shall not be less than two years.
(iii) Documentary evidence that the car has been
paid for from funds abroad.
(iv) Bill of lading (in the case of car
imported as unaccompanied baggage) showing freight pre-paid and shipment of the
car within ninety days from the date of the arrival of the importer in
Pakistan.
(v) If the car has been brought on Carnet-de-Passage
or Triptique, no objection certificate from Carnet or Triptique by the
concerned customs authority for retention of car in Pakistan shall be produced.
(3) Documents mentioned at paragraph (iii) of
sub-clause (2) shall not be necessary if the car was already registered abroad
in which case a certificate of registration shall be produced.
(4) A car imported by non-priviliged foreign
national on Carnet-de-Passage or
Triptique shall not be sold, transferred or alienated in any manner except as specified in sub-clause
(5) and (6).
(5) A car specified in sub-clause (4) may be
sold, after the expiry of two years from the date of import, to a foreign
national residing in Pakistan
against his own foreign exchange held abroad or to the Department of
Supplies, Government of Pakistan.
(6) A car imported by a non-priviliged
foreign national on payment of customs-duty and sales tax shall be allowed to
be sold to a Pakistani national after
expiry of three years.
(7) A foreign wife of a Pakistani national
who retains her foreign nationality shall be treated as foreign national for
the purpose of import of a car and the
car imported by her shall be subject to the same restrictions in the matter of
sale or transfer or re- export from Pakistan as are applicable to cars imported
by foreign nationals unless she acquires Pakistani nationality.
7. Permission to re-export the vehicles brought in contravention
of the rules.- Where a vehicle is
brought into Pakistan by a Pakistani national in contravention of these Rules,
he may be permitted to re-export such vehicles:
Provided
that where the importer brings such vehicle against fake or forged documents,
he shall, in addition to the confiscation of the vehicle, be liable to such
other penalty as may be imposed under any law for the time being in force.
8. All import Permits
issued prior to coming into force of this Order shall remain effective till
their validity.

In consideration of
the Government of Pakistan or of the officer authorised in this behalf
(hereinafter called the Authority) having granted import permission dated
_____________ for Rs._______________ (Rupees________________________________
only) to Mr____________________________________ hereinafter called the importer
for import of the ...............
inspite of the fact
that the document(s) (name and full address) specified in the margin has/have
not been produced by the importer. We
hereby gurantee that if the importer fails to produce before the Authority the
said document(s) within__________ months from the date of issue of the importer
permission, we the _____________________(Bank)
_____________________________________ will:
A. Surrender to you a sum of
Rs._____________ (Rupees____________________________________ only) being an
amount equavalent to the current market value of the said car/motor vehicle.
B. Surrender the said amount within
one month of the date of expiry of the stipulated period without notice from the
Authority or in the event of our failure to do so, within interest thereon at
the rate of nine per cent per annum commencing from the date of default, within
such period thereafter as the Authority may fix in this behlaf with notice.
We
hereby solemnly affirm that this guarantee is unconditional and that it is
expressly understood that the sole judge for deciding whether or not the
importer has produced the document(s) required, shall be the Authority.
(b) I did not apply to any other office
of the Authority for permission to import the car and no such permission has
been refused.
(c) I had not furnished an undertaking to
the said Authority or any other authority of the Government of Pakistan which
would render me in eligible to import
the car for which this application is made.
(d) That the car has been purchased out
of my earnings outside Pakistan.
(e) The information given in the
documents furnished with this application is correct and I fully understand
that if at any time any information
herein given is found to be incorrect or document herewith attached is found to
be false or inaccurate, I shall be liable to penalty under the Imports and
Exports (Control) Act, 1950 (XXXIX of 1950), and such law as may be applicable.
*Not applicable for
gift cases, where import permission is requested by family member residing in
Paksitan.

(13) Undertaking.- I do hereby undertake as follows:
(a) From
Pakistani Nationals.
"That neither any member of my family nor I shall import another car
for a period of two years (from the date of impor of the car) even if I am
transferred/posted or go abroad within this period."
(b) From non-privileged foreign
nationals.-
"that I shall not sell, mortgage
or otherwise dispose of the car in Pakistan for a period of two years even to
another foreign national
or to a Government organisation and before three years to a Pakistani national
(After two years the car could be sold to another foreign national or to a
Government Organization after obtaining prior permission to that effect)".
